Bankruptcy is a process in which a person or entity, such as a corporation, declares that they are unable to meet their financial obligations as they come due and requests the protections of the bankruptcy code. In order to declare bankruptcy, one must file a petition and bankruptcy schedules with the bankruptcy court that set forth the assets, liabilities, income, expenses and basic financial dealings of the party seeking protection. There are three basic types of bankruptcy proceedings, Chapter 7, Chapter 13 and Chapter 11.
